(i) Posting any incomplete, false or
inaccurate information or information which is not Your own in your Job Posting
or Resume.
(ii) Posting non-employment related
information such as opinions, or notices, commercial offerings or other
information regarding the sale, transfer or assignment of any products or
services, whether on a stand alone basis or contained within your Resume or Job
Posting.
(iii) Posting Resumes or Job Postings on
behalf of others, except that headhunters, employment placement/outplacement
agencies, temporary worker agencies, and other consultants may post Job Postings
upon the express authorization of a third party whom they represent or assist in
seeking Candidates to fill the third party’s employment opportunities.
(iv) Responding to or contacting any
Employer for any reason other than to apply for a Job Posting, or to inquire
further about the position with the bonafide intent to apply for it.
Communications soliciting an Employer's business are prohibited.
(v) Responding to or contacting any
Candidate for any reason other than to initiate further discussions with the
Candidate about potential employment or the Candidate’s Resume. Communications
by recruiters, search firms, or others soliciting Candidate(s) other than for
potential employment opportunities are prohibited.
(vi) Posting a Job Posting that
includes any franchise, pyramid scheme, "club membership", distributorship or
sales representative agency arrangement or other business opportunity which
requires an upfront or periodic payment from, pays commissions only (without a
significant salary) to, and/or requires recruitment of other members,
sub-distributors or sub-agents by, Candidates.
(vii) Deleting or revising, or
misappropriating as your own, any material posted on the Web Site by any other
person or entity.
(viii) Posting a Resume, Job Posting
or other material that violates any applicable law or regulation, or third party
right, including but not limited to copyright, trademark, trade secret, patent,
or other intellectual property rights, rights privacy or
publicity.
(iv)
Posting a Resume, Job Posting or other material that may be considered libelous,
obscene, pornographic, threatening, abusive, hateful, or defamatory, at the
Company’s sole discretion.
Section 3. No Guarantee of
Results.
You assume all responsibility and risk for your use of the Web Site and
the Services, and your conduct on the Web Site including posting or accessing
Resumes and/or Job Postings and communicating with other Users.
The Company does not represent or
guarantee the truthfulness, accuracy, or reliability of any Resumes, Job
Postings, or communications posted by Users, or endorse any opinions or
information expressed by Users. You acknowledge that any reliance on material
posted by other Users will be at your own risk. You acknowledge and agree that
You are solely responsible for the form, content and accuracy of any Resume or
Job Posting placed by You on the Web Site.
The Company is not to be
considered to be an employer with respect to the Web Site, and the Company shall
not be responsible for any employment decisions, for whatever reason made by any
Employer posting Job Postings on the Web Site. The Company makes no
representations to any Candidate regarding the effectiveness of the Web Site or
Services for your purposes. The
Company makes no guarantees to any Candidate that your use of the Web Site and
Services will result in your finding employment of any sort, on a timely basis,
and/or for any duration of time. Further, the Company shall not be responsible
for any employment decisions, for whatever reason made.
The Company is not to be considered
an employment agency or recruiter, and makes no representations to any Employer
regarding the effectiveness of the Web Site or Services for your purposes. The
Company makes no guarantees to any Employer that your use of the Web Site and
Services will result in You finding suitable Candidates or employees, on a
timely basis and/or for any duration of time.
The Company is not responsible for
screening or monitoring communications, Resumes, and Job Postings in advance. If
notified by a User of material which violates the Terms of Use, the Company may
investigate the allegation and determine in good faith and its sole discretion
whether to remove the material. The Company has no liability or responsibility
to Users for performance or nonperformance of such monitoring activities. The
Company reserves the right to expel Users, terminate their User account, and
prevent their further access to the Web Site for violating these Terms of Use or
the law and the right to remove material which is abusive, illegal, disruptive,
immoral, obscene, or defamatory in Company’s sole discretion.
Section
4. Registration, Password and User Information.
The
Company may use and disclose the information it obtains as a result of your
registration with the Web Site, including but not limited to your IP address,
name, mailing address, and email address (“User Information”), (i) in connection
with providing the Services to Candidates and Employers as the case may be, (ii)
to the extent necessary to comply with applicable laws or as required by Court
order where such information is relevant, and (iii) pursuant to the Company's
Privacy Policy.
If You cancel your Web Site account,
all your User Information, Resumes and Job Postings, will be removed from the
Company’s databases and cannot be retrieved thereafter.
Your Web Site login and password may
only be used by You to gain access to the Web Site and your User Information and
may not be shared with others. You
are solely responsible for maintaining your Web Site login and password as
confidential. Upon becoming aware
of any unauthorized use of your login and password, You shall immediately notify
the Company of such.
